Terms of Use

1. Agreement

These Terms of Use ("Terms") are an agreement between you and Home M K Inc., Ontario, Canada ("SnipSimple", "we", "us"). By downloading or using the SnipSimple app (the "App"), SnipSimple Cloud, or snipsimple.com, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

The App is distributed through Apple's App Store, and Apple's Licensed Application End User License Agreement ("Apple EULA") also applies. Where these Terms are more specific to the App, they apply between you and us. The Apple EULA continues to apply to your relationship with Apple. Apple is a third-party beneficiary of these Terms and may enforce them against you.

2. What the App does

SnipSimple takes screenshots of your Mac's screen, lets you mark them up, and copies, saves or uploads them. Uploading is optional. It sends the image to SnipSimple Cloud, or to a Cloudflare account of your own, and copies a link to it.

3. Licence

We grant you a personal, limited, non-exclusive, non-transferable licence to install and use the App on Apple devices that you own or control, as permitted by the App Store terms. You may not copy, modify, distribute, sell or lease any part of the App. You may not circumvent any purchase or feature-gating mechanism, or any limit of SnipSimple Cloud.

4. Free and paid features

The App is free to download and its free tier has no time limit. Two optional purchases unlock more, as described on the pricing page:

• Lifetime is a one-time purchase. It unlocks all local features and uploading to your own Cloudflare account. It does not include SnipSimple Cloud.
• Cloud is an auto-renewing yearly subscription. Anyone can try it free for 14 days, on any plan. It includes everything in Lifetime plus uploading to SnipSimple Cloud.

Current prices are shown in the App Store in your local currency, and applicable taxes may be added. Prices may change for new purchases. A change never affects a Lifetime purchase you have already made, and a subscription price change takes effect only as Apple's rules allow, with notice to you.

A Lifetime purchase unlocks the App's paid local features for as long as the App is available on the App Store and supported by us. Purchases are tied to the Apple Account that made them, work on every Mac signed in with that account, and cannot be transferred to another Apple Account.

5. Subscriptions and free trial

• The free trial is available once per Apple Account. If you do not cancel at least 24 hours before the trial ends, the subscription starts and your Apple Account is charged.
• Payment is charged to your Apple Account when the trial ends, or when you confirm the purchase if you have no trial.
• The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within the 24 hours before the current period ends.
• You can manage or cancel the subscription in the App Store app › your account › Subscriptions. Cancelling takes effect at the end of the current period, and you keep access until then.
• Deleting the App does not cancel a subscription.

6. Restore purchases

If you reinstall the App or use it on another Mac, sign in with the same Apple Account and use Restore Purchases in the App to restore your subscription or Lifetime purchase at no charge.

7. Refunds

All purchases are made through Apple, and Apple handles refund requests under its own policies. To request a refund, use reportaproblem.apple.com or contact Apple Support. We are not able to issue refunds directly.

8. Your content and uploads

Your screenshots belong to you, and we claim no rights in them. When you upload to SnipSimple Cloud, you give us permission to store the image and serve it to anyone who opens its link, only for as long as needed to provide the service. Uploads expire after 90 days, and you can delete them earlier as described in the Privacy Policy.

You are responsible for what you upload and for who you share links with. Anyone who has a link can open the image. SnipSimple Cloud is not a backup or long-term storage service, so keep your own copies of anything you need.

9. Acceptable use

You agree to use the App and SnipSimple Cloud only for lawful purposes. You must not upload content that is illegal, that infringes anyone's rights, that sexually exploits minors, or that is used to harass, defraud or spread malware. You must not interfere with the service or try to bypass its limits, which are currently 20 MB per image and 500 uploads per Mac per day, within fair use.

We remove content when we receive a lawful request or a valid abuse report. We may suspend a device token that is used to break these rules.

10. Your own storage

If you upload to your own Cloudflare account, your images are stored under your agreement with Cloudflare and are not part of SnipSimple Cloud. You are responsible for that account, its costs and its settings.

11. Third-party services

The App depends on Apple platforms and services, including macOS and the App Store, which are governed by Apple's terms. SnipSimple Cloud runs on Cloudflare. Changes these providers make may affect how the App works, and we may need time to adapt or may be unable to work around them.

12. Updates and availability

We may update, change or discontinue features of the App or SnipSimple Cloud, and may release updates that require a newer version of macOS. We aim to keep the App and SnipSimple Cloud available and supported, but we cannot guarantee availability indefinitely. If we discontinue either, we will give reasonable notice where practical.

13. Disclaimer

The App and SnipSimple Cloud are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the extent permitted by law. We do not warrant that uploads will always be available or that a link will work for the full 90 days.

14. Limitation of liability

To the maximum extent permitted by law, Home M K Inc. will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, arising out of or related to the App or SnipSimple Cloud. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose, or USD 30 if you paid nothing. Some jurisdictions do not allow certain limitations. In that case these limits apply to the fullest extent the law permits.

15. Termination

You may stop using the App at any time by deleting it. This does not cancel a subscription, see section 5. We may suspend or terminate your licence or your access to SnipSimple Cloud if you materially breach these Terms. Sections 8, 13, 14 and 16 survive termination.

16. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Any dispute will be brought in the courts located in Ontario, Canada, and you consent to their jurisdiction. If you are a consumer, nothing in these Terms takes away rights that the mandatory consumer-protection law of your place of residence gives you.

17. Changes to these Terms

We may update these Terms from time to time. The current version is always posted at this address with its effective date. If a change is material, we will note it in the App's release notes or on this page. Continued use of the App after a change takes effect means you accept the updated Terms.
